NOTICE OF PUBLIC HEARING

TO:     THE RESIDENTS AND PROPERTY OWNERS OF THE CHARTER TOWNSHIP OF HAMPTON

Notice is hereby given that the Charter Township of Hampton Planning Commission will hold a public hearing on Thursday, December 8, 2022 at 7:00 p.m. in the meeting room of the Hampton Township Hall, 801 West Center Road, Essexville, Michigan 48732, to conside1· at the request of the applicant, Golder Associates USA, Inc., as Agent and on behalf of Consumer's Energy Company, owners of the below-described property, for a special use permit which would allow it to construct and maintain a borrow pit (pond) on property currently zoned industrial (I) within the Charter Township of Hampton, County of Bay, State of Michigan. Under the Zoning Ordinance, ponds are permitted in said zone only by special use permit, granted by the Planning Commission following hearing. Said property for which the special use permit is commonly referred to is 2305 N. Boutell Road, SE, Essexville, Michigan 48732 and the development site is generally located between Jones and Boutell Road. The (property tax no. 09-070-012-200-00S- 00) all in the Township of Hampton being portion of sections(1), (2), (11), and (12 T14N R5E) of Charter Township of Hampton, County of Bay, State of Michigan and legally described (respectively) as follows:

You are welcome to attend and express your opinions at the hearing or you may express your views in writing. The application and proposed plans for the special use permit and site plan will be available for review and inspection at the Township offices between the hours of 9:00am to 11:00am and I:00pm to 3:00pm, Monday through Friday, excluding holidays. All communications must be received at the Township offices prior to the date of the hearing. You may also have a Representative speak on yow· behalf at said Hearing of you wish.

NOTICE OF PUBLIC HEARING- SPECIAL USE PERMIT

TO: THE RESIDENTS AND PROPERTY OWNERS OF THE CHARTER TOWNSHIP OF HAMPTON

Notice is hereby given that the Charter Township of Hampton Planning Commission will hold a public hearing on Thursday, December 8, 2022 at 7:00 p.m. in the meeting room of the Charter Township of Hampton Hall Complex, 801 West Center Road, Essexville, Michigan 48732, to consider at the request of the applicant, McKenna Development, LLC, potential purchasers of property commonly known as 1377 West Center Road, Essexville, Michigan, 48732, Parcel ID#: 09-070-025-100-015-00 for a special use permit that would determine whether their proposed reuse of the former Kmart building into a inside storage unit complex would be permitted pursuant to the Township Zoning Ordinance specifically section I1.02 A.15 which allows other principal uses determined by the Planning Commission to be of a similar nature to uses listed by right and subject to a special use permit. The property is currently zoned 1-1, Planned Enterprise District, which allows various uses permitted by right such as laboratories, manufacturing compounding processing, warehousing, distribution wholesale establishments, municipal buildings, indoor recreation centers, medical and executive administrative professional offices and facilities, corporate offices, etc. However, within the zoning classification other uses as noted above are permitted by special use as granted by the Planning Commission if it decides that this use is similar in nature although not specifically granted by right. The contemplated use is to convert the old Kmart structure which was attached to the former Hampton Mall on the east end of the property into a self-contained, inside storage facility.

The application and option of purchase are available for your inspection although personal information has been deleted from the option of purchase. The current owner is Dore Hampton, LLC, which has granted permission to McKenna Development, LLC to seek this special use as a condition of sale of the property to McKenna Development, LLC. Therefore, it is necessary that everyone be notified of this public hearing and afforded an opportunity to express their views. You may also inspect the documentation and leave written comments at the office of the Clerk of the Charter Township of between the hours of 9:00am to 11:00am and 1:00pm to 3:00pm, Monday through Friday, excluding holidays. The written comments must be received prior to the date of the Hearing. You may attend the Hearing in person or may have a Representative attend in your stead and express your views regarding this issue.
