To the residents and property owners of the Charter Township of Hampton, please take notice that the Charter Township of Hampton Zoning Board of Appeals will conduct a public hearing on Thursday, April 18, 2024 at 7:00 p.m., in the meeting room of the Hampton Township Hall, 801 W. Center Avenue, Essexville, Michigan 48732 to consider at the request of the owner of the below described property a variance that would enable it to exceed the maximum square footage of its sign on the parcel described.  The parcel is the former K-Mart building, now known as and owned by SOA Center, LLC, which would be permitted pursuant to the ordinance a 150 square foot of wall signage.  The applicant is seeking a variance of 145 square feet to enable a sign (total 295 square feet), to be placed on the property, on the North side of the building, which is far less than the 10% maximum wall surface permitted under the ordinance.  However, it is almost twice what the ordinance permits for wall signage in total.

The property is commonly referred to as 1377 W. Center Avenue, Essexville, Michigan 48732 and has tax parcel no.: 070-025-100-015-00 and is zoned B2, General Business.

NOTICE OF PUBLIC HEARING

TO:      THE RESIDENTS AND PROPERTY OWNERS OF THE CHARTER TOWNSHIP OF HAMPTON

            Please take notice that the Charter Township of Hampton Planning Commission will conduct a Special Public Hearing on Thursday, April 25, 2024, at 7:00 p.m., in the meeting room of the Hampton Township Hall, 801 W. Center Road, Essexville, Michigan 48732 to consider at the request of the owner of the below described property Consumers Energy to rezone the southern portion of the property from R-5 (Special Density Residential District) to B-3 conditional rezoning (Heavy Commercial Industrial Transition District with conditions).  The parcel already has split zoning designation; North part B-3 and Southern part R-5.  The applicant is requesting the R-5 be re-zoned to B3 with the conditions submitted by the applicant that there will be a site plan approved with additional landscaping along Hampton Road (similar to the plans for Arms Road) to mitigate the concerns of the public and the surrounding neighborhood as well as limiting the commercial zoning use to being only solar energy sites as permitted in Chapter 29 of the Zoning Ordinance, “large-scale solar voltaic installation”.  This parcel is generally east of the city limits for the City of Essexville and north of Hampton Road and immediately south of what had been developed as the Karn Weadock Plant for Consumers Energy. Additionally, this parcel has a right of way for utility, gas and other transmission and distribution lines and does not apparently have any structures requiring it to have a street address.

            The overall legal description of the parcel of property which has the Northern portion already zoned B3 and the Southern portion zoned R5 is the NE ¼ of the NW ¼ & the W 30 A of the SE ¼ of the NW ¼. S13, T14N, R5E, all within the Charter Township of Hampton, Bay County, Michigan.

            You are welcome to attend the hearing, have others represent you at the hearing or give written comments to express your views.  The application and supporting documentation are available for inspection at the offices of the Township Clerk between 9:00 a.m., and 11:30 a.m., or 1:30 p.m., and 3:00 p.m., Monday through Friday, excluding holidays.  Written comments must be received prior to the date of the hearing.
